These Terms of Service (“Agreement,” “Terms”) govern your use of services provided by Central VA Net, Inc. (“Central VA Net,” “we,” “us,” or “our”), including our website https://centralva.net and the CentralVA.net Control Panel (CP). By using our services, you (“Customer,” “Client,” or “you”) agree to comply with and be bound by these Terms. If you do not agree, you must discontinue use of our services immediately.

1. Services Provided

Central VA Net provides web hosting, domain registration, email, and related online services (“Services”) in accordance with this Agreement. Services may include, but are not limited to:

• Shared, managed, or dedicated web hosting.
• Domain name registration and renewal.
• Email and DNS hosting.
• Website management tools through the CentralVA.net Control Panel (CP).
• Technical support, as outlined in your service plan.

2. Account Registration and Responsibility

To use our Services, you must create an account through the CentralVA.net Control Panel (CP) and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities under your account, whether authorized or unauthorized.
• Notifying us immediately of any unauthorized access or security breach.

Central VA Net is not liable for loss or damage resulting from failure to maintain account security.

3. Acceptable Use Policy

You agree to use our Services only for lawful purposes. You may not use our Services to:

• Host, distribute, or transmit any unlawful, harmful, abusive, defamatory, or obscene content.
• Engage in spamming, phishing, or distribution of malware.
• Infringe upon the intellectual property rights of others.
• Interfere with the normal operation, security, or performance of our systems or network.
• Run resource-intensive processes that disrupt other customers’ use of the service.

Violation of this policy may result in service suspension or termination without prior notice.

4. Billing and Payment

4.1. Billing Cycle

All hosting and service fees are billed on a recurring basis (monthly or annually) as specified during sign-up.

4.2. Payments

• Payments are due on or before the 1st of each month unless otherwise stated.
• Accepted payment methods are listed in the CentralVA.net Control Panel (CP).
• A 1.5% late fee per day may apply to overdue balances.
• Accounts more than 30 days past due may be suspended or terminated.

4.3. Cancellations and Refunds

• Service cancellations must be submitted in writing via the Control Panel or email to billing@centralva.net.
• Prepaid fees are non-refundable unless otherwise required by law.
• Central VA Net reserves the right to cancel or suspend services for non-payment or violation of these Terms.

5. Service Availability and Maintenance

Central VA Net strives to provide 99.9% uptime for hosting services. Scheduled maintenance or emergency updates may result in temporary service interruptions, which we will minimize and, when possible, announce in advance. We are not responsible for downtime caused by:

• Customer misconfiguration or misuse.
• Third-party service interruptions.
• Force majeure events (natural disasters, network outages, etc.).

6. Data Backup and Security

While Central VA Net may perform periodic backups for system integrity, customers are solely responsible for maintaining backups of their websites, databases, and data. We strongly recommend maintaining independent backups stored offsite. Central VA Net is not liable for data loss resulting from user actions, hardware failure, or service interruption.

7. Domain Registration and Ownership

When registering or renewing domain names through Central VA Net:

• You agree to the terms of the domain registrar and ICANN policies.
• You are responsible for ensuring your registration information is current and accurate.
• Failure to renew on time may result in domain loss, for which Central VA Net assumes no liability.

8. Content Ownership

You retain all rights to content hosted under your account. However, you grant Central VA Net the limited right to store, transmit, and display such content as necessary to provide Services. You are responsible for ensuring your content complies with all applicable laws and does not infringe on third‑party rights.

9. Limitation of Liability

To the fullest extent permitted by law, Central VA Net, Inc. shall not be liable for:

• Indirect, incidental, consequential, or punitive damages.
• Loss of data, revenue, profits, or business arising from use or inability to use our Services.
• Any damages exceeding the total amount you paid to Central VA Net in the three (3) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Central VA Net, Inc., its employees, officers, and affiliates from any claims, damages, or expenses (including reasonable attorney’s fees) arising from your use of our Services or violation of these Terms.

11. Suspension and Termination

Central VA Net may suspend or terminate Services at its sole discretion if:

• You violate these Terms or the Acceptable Use Policy.
• Payment is overdue.
• Your account activity poses a security or legal risk.

Upon termination, all customer data may be deleted from our systems without further notice.

12. Modifications to Terms

We may modify these Terms at any time. Updates will be posted at https://centralva.net with a revised “Effective Date.” Continued use of our Services constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Lynchburg, Virginia.
